Defective Product Recall of Childen’s Bean Bag Chairs After Death of Two Children Reported

| Aug 31, 2014 | Firm News

San Diego parents should be aware of a recent recall related to children’s bean bag chairs made by Ace Bayou Corp. The defective product presents a suffocation and/or choking hazard, and has tragically caused the death of two children.

According to the Consumer Product Safety Commission, the recall applies to two specific models of the Ace Bayou bean bag chairs that were sold prior to July 2013 in retail stores such as Walmart, Wayfair, Amazon.com and the company’s website at www.acebayou.com. The manufacturer of these bean bag chairs issued the recall reports that two children died from using the defective bean bags. The recall applies to 2.2 million bean bag chairs and stems from reports of children crawling inside the bean bag through the zippered opening, getting trapped and inhaling the foam beads.  A 13-year old boy from McKinney, Texas died and a 3-year-old girl from Lexington, Kentucky were found inside the chairs after suffocating on the bean bag beads.

According to California law, manufacturers are required to supply the public with products that are safe for their intended uses. Occasionally, manufacturers or distributors fail to properly test a product before selling it.  If a dangerous product injures or causes the wrongful death of a loved one, the manufacturer may be held liable, especially if the company failed to correct and make safe potential dangers or risks.

When a consumer suffers an injury as a result of a defective product, a number of parties can be held responsible for supplying or selling a product that they knew or should have known was dangerous to consumers. Those involved in the chain of commerce of the defective product, such as the manufacturer, distributer, or retailer may be held liable for putting a dangerous product into the marketplace. A person or company can be held liable for a number different kinds of products such as a defective children’s bean bag, child car seats, faulty medical devices and other products like sporting equipment or power tools.
