New Law Enacted to Prevent San Diego Bicycle Accidents

bike accident lawyerOn Tuesday, September 16, a new law will take effect that will provide Southern California bicyclists with added safety on the roadways.   The new law will require drivers to allow for at least 3 feet clearance when passing a bicyclist on the roadway.  The new legislation is designed to help prevent Southern California and San Diego bicycle accidents.  Drivers must also keep their distance before it is safe to pass.  Motorists who are caught not allowing a safe 3 foot clearance when passing a cyclist on the road will face a fine between $35 and $200.  If an accident is involved, the fine can increase up to $1,000.

According to the League of American Bicyclists, up to 40 percent of all fatal bike accidents are caused by unsafe passing. Those accidents usually take place when bicyclists get hit from behind.  This new legislation will help to alleviate some accidents by requiring increased safety by motorists when passing a cyclist.

By far, the most common type of bicycle accident is an accident with a motor vehicle. This new legislation will help to protect bicyclists who are more vulnerable on the road.  Careless and negligent motorists create a significant risk of injury or death to bicycle riders who do not have the same level of protection as a person riding in a car.

If you were hit and injured by a car or other vehicle while riding your bike, a San Diego Bicycle Accident Attorney can assess your case and advise who may have liability for you injuries.  If a motorist is negligent or violates a traffic law such as an improper pass or driving at an unsafe speed, they may be responsible for any injuries they cause to a cyclist.

If a third party is at fault for your bicycle accident injuries, you may seek monetary compensation for your injuries and damages.  Under the law, you are entitled to compensation to make you “whole” to the extent possible for your injuries. Damages can be awarded for medical expenses, past and future pain and suffering, lost wages or future earning capacity, and any other out of pocket expenses.  If you’ve been involved in a bicycle accident, contact an experienced Riverside and San Diego personal injury attorney to evaluate your claim.  The attorneys at Martinez & Schill LLP offer free consultations.  Call us at 619-512-5995 or (951) 400-4630.
